By accessing this website, purchasing from us or using our services, you agree to these Terms and Conditions and any policies referred to in them, including our Shipping Policy, Refund Policy and Privacy Policy.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer right or remedy that cannot legally be excluded under the Australian Consumer Law.

3. PRODUCT INFORMATION
We make reasonable efforts to ensure that product descriptions, photographs, prices and availability are accurate.
Colours and appearance may vary slightly depending on lighting, photography and the screen used to view the product. Natural gemstones may also have individual variations in colour, pattern and inclusions.
Measurements and weights may be approximate unless expressly stated otherwise.
If we discover a material error affecting an order, we will contact you and offer an appropriate solution, which may include confirming the corrected information or cancelling the affected item and issuing a refund.
Nothing in this section limits your rights under the Australian Consumer Law.
4. PRICES AND PAYMENT
Unless otherwise stated, prices are displayed in Australian dollars and include GST where applicable.
Shipping charges and any optional services are shown separately before an order is completed.
Payment must be made using one of the payment methods available at checkout. You confirm that you are authorised to use the payment method supplied.
Prices, promotions and product availability may change without notice. Changes will not affect an order that we have already accepted, except where we contact you about an obvious pricing or listing error.
5. ORDERS
Submitting an order does not guarantee acceptance. We may decline or cancel an order where reasonably necessary, including when:
• An item is unavailable
• Product or pricing information contains a genuine error
• Payment cannot be authorised
• We reasonably suspect fraud or unauthorised activity
• Delivery is unavailable to the supplied address
• An order appears to be intended for unauthorised resale
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.
Please check your name, email address, telephone number and delivery address carefully before submitting your order.
6. PRODUCT AVAILABILITY
Products may be available in limited quantities. An item may occasionally sell in-store before our online inventory is updated.
If an ordered product becomes unavailable, we will contact you as soon as reasonably possible and offer a refund or, with your agreement, a suitable alternative.
7. CUSTOM, PERSONALISED AND SPECIAL ORDERS
Custom-made, engraved, personalised and specially ordered products may require additional processing time.
Customers are responsible for checking names, dates, wording, sizes and other personalised details before approving an order.
These products are not ordinarily eligible for a change-of-mind return. However, this does not affect your rights if the product is faulty, incorrectly supplied or otherwise fails to meet a consumer guarantee under the Australian Consumer Law.
8. SHIPPING AND DELIVERY
Orders are shipped in accordance with our Shipping Policy.
Shipping prices, available services and estimated delivery timeframes are displayed at checkout where available. Delivery estimates are not guaranteed and may be affected by carrier delays, public holidays, remote locations, severe weather and other circumstances outside our reasonable control.
Customers must provide a complete and accurate delivery address. Please contact us promptly if an address needs to be corrected. We cannot guarantee that an address can be changed after an order has been dispatched.

9. RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges and refunds are handled in accordance with our Refund Policy and the Australian Consumer Law.
Our voluntary change-of-mind policy operates in addition to your legal rights. The conditions or exclusions applying to change-of-mind returns do not remove your rights when goods are faulty, damaged, incorrectly supplied or otherwise fail to meet a consumer guarantee.
10. AUSTRALIAN CONSUMER LAW
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Where we supply services, those services are also subject to any consumer guarantees that apply under the Australian Consumer Law.

Unless otherwise stated, the content on this website—including text, photographs, graphics, logos, designs and other material—is owned by or licensed to The Gem Centre.
